VahanSetu Terms of Use
Effective Date: 15th March, 2026
These Terms of Use govern your access to and use of VahanSetu, an automotive B2B software application owned and operated by RPS CAR HO YA BIKE LLP.
1. Acceptance of Terms
By downloading, installing, or logging into VahanSetu (the "Application" or "Service"), you agree to be bound by these Terms of Use, our Privacy Policy, and our Refund Policy. If you do not agree, you must immediately uninstall and discontinue using VahanSetu.
2. Pure B2B Intermediary & Technology Platform
VahanSetu is designed solely as a business utility for verified automotive dealerships, independent used vehicle brokers, and trading agents. RPS CAR HO YA BIKE LLP is NOT an automobile dealer, broker, auctioneer, escrow agent, or transportation provider. We provide the digital software environment for inventory tracking, invoicing, client tasks, and partner communications.
3. Live Auction & Trading Rules
A. No Financial Settlement or Vehicle Custody: VahanSetu does not process vehicle purchase funds, accept down payments, or hold escrow. All financial settlements, title transfers, and token payments are negotiated and fulfilled directly between participating businesses.
B. No Logistics or Physical Handover: We do not verify odometer readings, physical vehicle condition, or deliver vehicles. Vehicle inspections and handovers remain 100% the responsibility of the selling dealer and purchasing broker.
C. Non-Binding Bidding & Discovery: Live bids and countdown windows represent digital price discovery. Whitelisting, acceptance of bids, and vehicle awards remain entirely within the discretion of the hosting dealership.
D. Whitelist Discretion: Dealers maintain absolute control over which brokers are whitelisted, allowed to bid, or removed from their auction network.
4. User Accounts & Responsibilities
You agree to provide true, current, and verified business information. You are solely responsible for maintaining the confidentiality of your login credentials and for all actions executed under your VahanSetu account.
5. User Data & Document Ownership
You retain full intellectual property ownership of the vehicle inventory photos, customer quotation records, and paperwork you upload into the document vault. Data processing rules are detailed in our Privacy Policy. You grant RPS CAR HO YA BIKE LLP a non-exclusive license solely to host and display this information back to your authorized team members.
6. Prohibited Conduct
You agree not to:
- Upload forged, fraudulent, or disputed vehicle Registration Certificates (RC) or transfer papers.
- Attempt to decompile, reverse engineer, or scrape data from the VahanSetu mobile app or backend APIs.
- Misrepresent your identity, dealership authority, or branch ownership.
7. Disclaimer of Warranties & Limitation of Liability
VahanSetu IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RPS CAR HO YA BIKE LLP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING COMMERCIAL FITNESS OR ACCURACY OF VEHICLE LISTINGS. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL LOSSES, DEFAULT OF VEHICLE PAYMENTS BETWEEN BUSINESSES, OR MISSED TRADING DEALS ARISING OUT OF THE USE OF VahanSetu.
8. Governing Law
These Terms shall be governed by the laws of India. Any legal dispute or proceeding arising under VahanSetu shall be subject to the exclusive jurisdiction of the courts of Madhya Pradesh, India.
